Summary

The EU has notified to the WTO SPS Committee (G/SPS/N/EU/646) a proposed change to set the MRLs for oxamyl at the limit of determination (LOD, the lowest level that can be detected using the most modern and reliable analytical methods) for all products, with particular impacts on eggplants, melons and watermelons (G/SPS/N/EU/646).

Recommended Actions

Competent authorities of countries that are members of the WTO can submit comments on the EU proposal by emailing the EU SPS Enquiry Point until 27 August 2023.

Exporters of affected products should review their current use of oxamyl and evaluate possible alternative solutions in anticipation of MRL changes.

Timeline

Expected adoption date: January 2024.

Expected entry into force: March 2024.

The new MRLs will apply from approximately May 2024 – the precise date will be known once the Regulation is published.

EU proposes to lower MRLs for oxamyl on all products

Update

The EU has notified to the WTO SPS Committee (G/SPS/N/EU/646) a proposed change to set the MRLs for oxamyl at the limit of determination (LOD, the lowest level that can be detected using the most modern and reliable analytical methods) for all products, with particular impacts on eggplants, melons and watermelons (G/SPS/N/EU/646).

All products but in particular aubergines/eggplants, melons and watermelons

What is changing?

The EU proposes to set the MRLs for oxamyl to the LOD for all products, with impacts on aubergines/eggplants (current MRL 0.02 mg/kg), melons and watermelons (current MRL 0.01 mg/kg). Many LODs will also be lowered to ensure consumer safety.

Why?

Oxamyl is no longer permitted for use in the EU. The existing MRLs set for oxamyl have therefore been deleted and set to the LOD. Additionally, EFSA (2022) identified that the default LOD value of 0.01 mg/kg does not provide a sufficient level of protection for consumers for most commodities, so that the LOD for these products should be set at lower, more protective levels (0.005, 0.002 or 0.001 mg/kg).
