What is changing?

The list of goods subject to official controls at border control posts is amended to narrow CN code 0410 to insects (0410 10) and other edible products of animal origin, not elsewhere specified or included (0410 90 00); and to specify the list of composite products (i.e. plant-based products mixed with food of animal origin).

This concerns the goods listed in Table 1 when they contain food of animal origin.

Why?

The changes to Harmonised System (HS) and Combined Nomenclature (CN) codes introduced by Delegated Regulation (EU) 2022/887 and Implementing Regulation (EU) 2021/1832 needed to be reflected in the lists of products subject to official controls at border control posts, in order to avoid any ambiguity about which consignments of goods are subject to official controls.

What are the major implications for exporting countries?

Exporters of any food containing food of animal origin (i.e. composite products) must be aware that this food is subject to official controls at border control posts. It means that controls are stricter, and may mean more time is needed before the goods can be delivered.

Food of animal origin used in composite products must be produced in compliance with the EU legislation dealing with food of animal origin (including public health, animal health and residue requirements).

Recommended Actions

Exporters of animal by-products and plant-based products mixed with food of animal origin must ensure that consignments for the official controls are prepared in the same way as food of animal origin.
