Composite products: Official controls

Commission Delegated Regulation (EU) 2023/1674 of 19 June 2023 amending Delegated Regulation (EU) 2021/630 as regards the inclusion of certain spreads and preparations for making beverages containing cocoa, certain prepared foods obtained from cereals or cereal products, certain prepared foods obtained from rice and other cereals, certain chips and crisps, and certain sauces and condiments in the list of composite products exempted from official controls at border control posts and amending Annexes I and III to Delegated Regulation (EU) 2019/2122

Update

The EU has extended the list of low-risk, shelf-stable composite products that are exempt from official controls at border control posts. The list now includes spreads and preparations for making beverages containing cocoa, products obtained from cereals, cereal products, prepared pastries, chips and crisps, prepared rice products, and miso and soy sauce containing a small amount of fish soup stock.

What is changing?

This Regulation adds the following to the list of low-risk composite products that are exempt from official controls at border control posts:

• shelf-stable composite products in the form of certain spreads and preparations for making beverages containing cocoa
• certain prepared foods obtained from cereals
• cereal products
• certain prepared foods obtained from rice
• certain chips and crisps
• miso containing fish soup stock
• soy sauce containing fish soup stock.

It covers the following:

• Combined Nomenclature (CN) codes 1905, 2005, 2104, 2016: Regulation 2019/2122 (Annex I Part 2)
• CN codes 1704/1806, 1904, 1905: Regulation 2021/630 (Annex)

Why?

These shelf-stable composite products pose a low risk to human and animal health.

Timeline

Date of effect: 21 September 2023.

What are the major implications for exporting countries?

Shelf-stable composite products under CN codes 1806 90 60, 1806 90 70, 1904 10, 1904 20, 1904 90, 1905 90, 2005 20 20 and 2103 will be exempted from official controls at border control posts. These composite products should now be controlled by the competent authorities at the place of destination, at the point of release for free circulation in the EU, or at the warehouses or the premises of the operator responsible for the consignment.

Background

Regulation (EU) 2022/2292 lays down requirements for composite products entering the EU from non-EU countries.

Certain low-risk, shelf-stable composite products not containing meat are exempt from official controls at border control posts (Regulation (EU) 2021/630).

Two existing Regulations list (1) the composite products to be controlled at border control posts (2019/2122); and (2) the goods that are exempt from official controls (2021/630). This new Regulation amends these two closely linked lists.
