Update

The EU has published a Regulation that amends technical rules for managing tariff rate quotas, including certain quotas for preparations of poultry meat (other than turkey).

What is changing?

The following issues are relevant to AGRINFO partners.

Poultry meat quotas

There has been an “excessive demand” [Regulation 2023/254, recital (7)] to import preparations of poultry meat (other than turkey) under quotas with the following two order numbers:

  • 09.4268 (all third countries other than China): 5,000,000 kg
  • 09.4269 (Chinese origin): 6,000,000 kg.

As a result, these quotas will now be managed under the LORI system.

Submitting too many tariff rate quota applications

Under Implementing Regulation (EU) 2020/761, the number of applications that may be made for a tariff quota is restricted. If operators make more applications than the maximum permitted number, all their applications are considered inadmissible and they lose any security that has been paid. The loss of securities is now considered to be a disproportionate punishment for submitting too many applications, and the new Regulation amends the rules. Submitting too many applications will now only lead to those applications being inadmissible.

Why?

In light of experience with the management of agricultural tariff rate quotas, the Commission is introducing a number of technical changes.

Timeline

The new rules regarding the need for LORI registration for poultry meat quotas will apply to the tariff quota starting in July 2023.

The new rules regarding multiple tariff rate quota applications will apply to licence application periods after 13 February 2023.

Recommended Actions

Suppliers of preparations of poultry meat (other than turkey) wishing to make use of certain tariff quotas – 09.4268 and 09.4269 – must now complete compulsory prior registration to apply for these quotas. This is done through the Licence Operator Registration and Identification (LORI) system. Guidance on how to register on LORI is available on the European Commission's Tariff rate quotas webpage.

Background

The Commission manages certain tariff rate quotas for which there is much demand through a process of prior registration. It has set up the LORI system, which must be completed by all operators interested in applying for these specific quotas.

A list of all agricultural tariff rate quotas, and an indication of whether compulsory registration through LORI is required, can be found in the Annexes to Implementing Regulation (EU) 2020/761.
